Terms & Conditions of Sale

Natural Material Variation

Engineered quartz slabs are manufactured in batches. Minor variations in color, shade, veining, and texture between slabs are inherent product characteristics and are not defects. West Harbor Surfaces does not warrant color consistency across different production lots or container shipments. Buyer is responsible for verifying lot matching before placing an order. Lot numbers are available upon request but cannot be guaranteed across separate orders.

Buyer's Obligation to Inspect

Buyer must inspect all materials at the point of pickup or delivery before fabrication or installation begins. Inspection must cover surface condition, dimensions, color, and any visible defects. Acceptance of materials at pickup or delivery confirms that products were received in satisfactory condition. West Harbor Surfaces bears no liability for defects or damage identified after materials have left our premises.

No Returns After Fabrication or Installation

All sales are final once materials have been cut, fabricated, or installed in any form. No returns, exchanges, credits, or claims will be accepted after fabrication or installation has commenced. Cutting or installation constitutes Buyer's acceptance of all material characteristics as-is

Cancellations, Returns, and Exchanges

All cancellation, return, and exchange requests require prior written authorization from West Harbor Surfaces. Unauthorized returns will not be accepted and will be returned at Buyer's expense. Authorized returns are subject to a 20% restocking and handling charge on the original invoice value.
All authorized returns must meet the following conditions:
- Uncut, unfabricated, and uninstalled
- Free of any damage not present at original sale
- In fully re-sellable condition
- Returned within the timeframe stated in the written authorization
West Harbor Surfaces reserves the right to refuse returns that do not meet these conditions or to assess additional charges for returned products received in diminished condition.

Payment Terms

Buyer agrees to pay the full invoice amount under the payment terms confirmed by West Harbor Surfaces. Invoice pricing supersedes all prior verbal quotes or informal communications. Materials will not be released until payment terms are satisfied. Accounts past due may be subject to a late charge of 1.5% per month on the outstanding balance and account suspension pending resolution.

Risk of Loss

Risk of loss transfers to Buyer at the point of pickup from West Harbor Surfaces' warehouse. For third-party carrier deliveries, risk transfers upon tender to the carrier. West Harbor Surfaces is not liable for loss, damage, or delay caused by carrier, acts of nature, or circumstances beyond our reasonable control.

Limitation of Liability

West Harbor Surfaces' total liability for any claim shall not exceed the original invoice value of the products in question. We are not liable for indirect, consequential, or incidental damages including lost profits, project delays, or costs of removal and reinstallation.

Governing Law

These terms are governed by the laws of the State of Washington. All disputes shall be subject to the exclusive jurisdiction of the courts of King County, Washington.

Acceptance

Placing a purchase order or accepting materials from West Harbor Surfaces constitutes full acceptance of these Terms and Conditions of Sale, which supersede any conflicting terms in Buyer's documents unless agreed to in writing by West Harbor Surfaces.
